INC-20A due date
Section 10A asks a company with share capital to file a declaration of commencement of business within 180 days of incorporation. Enter the date on the certificate of incorporation.
What section 10A asks for
A company incorporated after the Companies (Amendment) Ordinance, 2018 with share capital may not commence business or exercise borrowing powers until a director files a declaration, in Form INC-20A, that every subscriber to the memorandum has paid the value of the shares they agreed to take, and the company has verified its registered office with the Registrar under s.12(2) (s.10A(1)). The declaration is filed within 180 days of incorporation, with proof of the subscription money received.
The Act sets penalties for not filing, on the company and on each officer in default (s.10A(2)). If the declaration is not filed within 180 days and the Registrar has reasonable cause to believe the company is not carrying on business, the Registrar may begin removing its name from the register of companies (s.10A(3)).
A director signs the declaration; your company secretary usually prepares the form and keeps the evidence. This page only tells you the date.
